Conditions to be met to benefit from the CIF
- Seniority
To benefit from the CIF, the requesting employee must justify a seniority of 2 consecutive years or not as an employee, with at least 12 months in their current organization. This condition differs slightly if it is a craft business with fewer than 10 employees. The required seniority in this case will be three years. However, emphasis is placed on the employee under fixed-term contracts. The two years of seniority for this employee must be verified over the last five years with four months of work, consecutive or not, in the last twelve months.
- Leave request
The employee who wishes to benefit from the CIF must send a request for authorization of absence to their employer. It is advisable that this request be sent by registered letter with acknowledgment of receipt. It must indicate the title, date, and duration of the training as well as the organization that provides it. Duration of the leave
Regulatory provisions state that the duration of a CIF cannot exceed 1 year for full-time training and 1200 hours for part-time training.
Employee status during training
During the duration of the CIF, it is considered that the employee is still working. As a result, although their employment contract is suspended, the employee’s leave is paid in full and they also benefit from all social security advantages. However, for an employee whose gross salary exceeds €2,960.53, the remuneration paid to them per month is either 80% of the gross salary prior to leave for leaves of less than 1 year or less than 1200 hours, or 60% of the gross salary in the other case.
